In this privacy policy, we - the group of companies of the ALVARA | Digital Solutions brand - would like to inform you - as an applicant - about the processing of your personal data within the scope of joint responsibility within the group of companies.

Please note that when applying via third parties (e.g. online application platforms such as the Empfehlungsbund, Indeed or similar), your personal data will be processed independently of us by the respective service provider used. Please inform yourself in this regard in the respective data protection declaration of the service provider used by you for the application.

2. Purpose and nature of the processing of your personal data

We process your personal data at the times and for the purposes described below.

2.1 Conducting the application process

We process all the data that you have submitted to us as part of your application and have specified in your cover letter, CV and attachments. This includes contact details, additional personal details such as gender, age and nationality, as well as details of your school education and professional career and all other data provided as part of the classic structure of an application.

We need your personal data to process your application. The data you provide us with in the course of your application will only be used and processed for the purpose of selecting and evaluating applicants. If you provide us with your contact details as part of your application, we will use these to communicate with you.

Your personal data will be processed on the legal basis of Art. 6 (1b) DSGVO and Art. 88 DSGVO in conjunction with §26 BDSG-Neu.

3. Shared responsibility & sharing within the group of companies

Within the application process, your personal data will be accepted and managed centrally by ALVARA Holding GmbH. Your personal data will then be forwarded to the company from the group of companies whose job advertisement you have applied for.

Within the respective company, your application and related personal data will be processed by different internal departments, based on the respective organisational structure and depending on the department in which the job advertisement you have applied for falls.

In any case, your personal data will only be processed by the organisational units responsible for the advertised position and the recruitment of new staff.

Within the framework of joint responsibility, the group of companies has concluded an agreement regulating joint responsibility. You can read the essential information according to Art. 26 para. 2 p. 2 DSGVO here.

4. Disclosure of your personal data to third parties

Except for the disclosure of your personal data within the scope of joint responsibility, we only disclose it to third parties if:

You have given us specific consent in accordance with Art. 6. para. 1 p. 1 lit. a DSGVO to pass on your personal data.
The disclosure is necessary on the basis of Art. 6 para. 1 p. lit. f DSGVO for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of the data.
We are legally obliged to disclose the data pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO.
The disclosure is legally permissible and necessary in accordance with Art. 6 Para. 1 Sentence 1 lit. b DSGVO for the processing of an existing or pending legal transaction.

In all other cases, your personal data will not be passed on to third parties.

5. Duration of the storage of your personal data

Your personal data will be stored for the entire duration of the application procedure. After the end of the application process, your personal data will be stored for a further 6 months to enable you to make any claims in accordance with §15 AGG.

6. Data subjects' rights

As a data subject, you have the right:

• Pursuant to Art. 15 DSGVO, to receive information from us free of charge within the legal framework as to whether we are processing personal data about you. If this is the case, you also have the right to request information about the data, the purpose for which it was processed, the recipients (in the case of data transmission) and its origin.
• In accordance with Art. 16 DSGVO, to request the correction of incorrect or incomplete personal data we have stored about you without delay.
• In accordance with Article 17 of the GDPR, request the erasure of your personal data stored by us, unless the processing is necessary for the free expression of opinion and information, the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims
• Pursuant to Art. 18 DSGVO, to request the restriction of the processing of your personal data if the accuracy of the personal data is disputed by you or the processing is unlawful, but you refuse erasure or the personal data is no longer required by us, but you need it to assert, exercise or defend legal claims or you have objected to the processing of your personal data pursuant to Art. 21 DSGVO.
• Pursuant to Art. 20 DSGVO, to receive your personal data processed by us in a structured, common and machine-readable format or to request the transfer of this same personal data to another controller.
• In accordance with Art. 7 (3) DSGVO, to revoke your consent given to us at any time. As a result, we may and will no longer process the personal data affected by this consent from the time of the revocation.
• Complain to a supervisory authority in accordance with Art. 77 DGSVO.

ALVARA Holding GmbH is at your disposal as a central contact point for asserting your data subject rights. However, you are free to contact any company of the group of companies.

7. If the provision of personal data is mandatory by law

The provision of personal data is neither legally nor contractually required, nor are you obliged to provide personal data.

However, the provision of personal data is necessary for the conclusion of a contract of employment with us in order to enable a review of your suitability for the position applied for.
